Dichotomy of Gender

In the concrete level, the problem around the gender is focused on discriminative handling/treatment. Analogously, the problem of gender just a praxis problems in daily life, therefore it’s just connected to law, array, and its sanctions. Exactly, the problem of gender isn’t simple thing.

The problem of gender indeed has the tight relation with behaviour paterns in praxis daily life, and this behaviour paterns are rooted in identity concepts where sex/gender is its root. In our concept on gender, there is discriminative gaze what man connected to abrupt, brave, pertinacious, hard worker, rational being, etc., while woman connected to delicate, fainhearted, fractious, emotional characters, etc. Additionally, this identity concepts are solely depended on their selves. Exactly, they are rooted on certain ontological frameworks/structures, namely elemental viewpoints on “fate, karma, fact, life, etc. Shortly, metaphysical concepts that rational, secular, religious, or traditional.

Law is laid between this concrete praxis and metaphysical abstract beliefs on gender. Law and its sanctions became interface/mediator so that the unwanted concrete problems can be arrested and well-suited to metaphysical frameworks. Conversely, law can be seen as manifestation and guarantor of the elemental metaphysical concepts. Therefore, its point lays on this metaphysical concepts.
